Article 1
Definitions
MellowMiles: the company that offers recreational rental of electric vehicles and tourist experiences.
Renter: the natural or legal person who enters into an agreement with MellowMiles.
Driver: any person who has been approved in advance by MellowMiles and drives the vehicle during the rental period.
Vehicle: the vehicle made available by MellowMiles, including the Fiat Topolino and any future vehicles.
Agreement: any reservation, rental or booking between MellowMiles and the renter.
Article 2
Applicability
These general terms and conditions apply to all reservations, agreements, offers and services of MellowMiles.
By making a reservation the renter declares to agree to these terms.
Deviations are only valid if confirmed in writing by MellowMiles.
Article 3
Reservations and payments
A reservation is final after:
- the reservation has been confirmed by MellowMiles;
- the agreed payment has been received.
MellowMiles reserves the right to refuse a reservation without stating reasons.
All prices include VAT unless stated otherwise.
Prior to the rental the renter receives these general terms and conditions. Before the vehicle is handed over, the renter signs the rental agreement and declares to have read these terms.
No later than 24 hours before the start of the rental period, the renter receives an email with information about the booking. This email contains:
- a link to pay the deposit;
- a link to digitally sign the rental agreement;
- important information about the booking and trip;
- practical information about the booking and trip.
Article 4
Driver requirements
Every driver must:
- be at least 21 years old;
- hold a valid driving licence permitting the vehicle to be driven;
- present a valid identity document;
- be personally present at the handover of the vehicle.
A photograph of the valid driving licence is taken from every driver.
If multiple drivers use the same vehicle:
- all drivers are registered in advance;
- the driving licences of all drivers are checked and photographed;
- all drivers sign the rental agreement and these general terms and conditions.
It is not permitted to have the vehicle driven by persons who have not been registered in advance by MellowMiles.
Article 5
Refusal or cancellation by MellowMiles
MellowMiles may refuse or cancel a reservation if this is necessary for safety or proper business operations. This includes, among other things:
- insufficient identification;
- failure to meet driver requirements;
- suspicion of alcohol, drug or medication use;
- illness or physical condition making safe driving inadvisable;
- aggressive or inappropriate behaviour;
- technical problems;
- extreme weather conditions;
- official weather warnings;
- calamities or safety advisories from authorities.
In the event of cancellation by MellowMiles, any rental fee and deposit already paid will be fully refunded.
Other costs such as travel, accommodation, catering, entrance, parking or consequential damage are not reimbursed.
Article 6
Safety check and vehicle inspection
Before every rental MellowMiles carries out a technical safety check. Items checked include, among others:
- tyres;
- brakes;
- lighting;
- safety systems;
- general technical condition.
This check is recorded internally.
Before and after every rental the vehicle is visually inspected together with the renter. Photographs are taken of the vehicle's condition. These photographs serve as evidence of the vehicle's condition at the start and end of the rental period.
Article 7
Use of the vehicle
The vehicle may only be used for recreational purposes. The following are not permitted:
- commercial transport;
- courier services;
- competitions;
- racing;
- aggressive driving behaviour;
- off-road driving;
- smoking;
- vaping;
- transporting pets;
- transporting heavily polluting or strongly odorous materials;
- use contrary to laws and regulations.
The driver must remain alcohol-free throughout the entire rental period for as long as he or she will still be driving the vehicle.
The renter treats the vehicle with care as if it were their own property.
Article 8
Traffic rules and fines
The driver remains fully responsible for compliance with all traffic rules.
All traffic fines, parking fines, penalty notices, surcharges, toll charges and other sanctions are entirely for the account of the renter.
If MellowMiles receives such costs, these will be passed on with an additional €15 administration fee per notice.
Article 9
Deposit
Unless otherwise agreed, the deposit amounts to €250.
The deposit will be refunded within five working days provided:
- no damage has been established;
- no outstanding costs exist;
- no known fines or surcharges are outstanding.
MellowMiles may offset outstanding amounts against the deposit.
Article 10
Insurance, damage and liability
The vehicle is insured in accordance with the third-party liability and comprehensive insurance taken out by MellowMiles.
No separate passenger insurance has been taken out for occupants.
The excess amounts to €250 per incident, unless the insurer applies a higher excess or exclusion under the policy conditions.
If the insurance does not provide cover due to actions contrary to these terms, intent, gross negligence, driving under the influence or unauthorised use, all resulting costs may be fully recovered from the renter and driver.
Damage must be reported to MellowMiles immediately.
If damage occurs while an unregistered driver is operating the vehicle, both the renter and that driver are jointly and severally liable for all resulting damage and costs.
Article 11
Theft and loss
Theft or loss of keys, documents, accessories or the vehicle must be reported immediately to MellowMiles and the police.
All costs arising from negligence or late reporting may be charged on.
Article 12
Cancellation by the renter
- Up to 48 hours before start: free of charge.
- Within 48 hours: 50% of the rental amount.
- Within 24 hours or no-show: 100% of the rental amount.
Article 13
Cleaning and vehicle condition
Normal soiling is included.
In the event of excessive soiling, smoke odour, vape odour, animal hair, mud, stubborn stains or other contamination, the actual cleaning and restoration costs will be charged.
Article 14
Late return
The vehicle must be returned no later than the agreed time.
In the event of overrun, €50 per commenced hour will be charged.
Any additional damage caused by subsequent bookings may also be recovered.
Article 15
Breakdown and malfunctions
In the event of a breakdown the renter contacts MellowMiles immediately. Having repairs carried out independently without permission is not permitted.
MellowMiles will make every effort to continue the trip as smoothly as possible. However, there is no right to a replacement vehicle. If a comparable vehicle is available, it may be deployed at the discretion of MellowMiles.
If continuation of the trip proves impossible, the parties will jointly seek an appropriate solution. Full or partial restitution of the rental fee is among the possibilities.
Any compensation for breakdown or failure is limited to a maximum of the rental amount paid.
Article 16
Routes, arrangements and vouchers
Renters who book a Dolce Go package choose their own route and do not receive a route map. If the renter has booked a Dolce Enjoy or Dolce Signature package, the renter receives a digital route map. This route map shows the exact route to be driven. Using the digital route map requires the OsmAnd Maps app, available for download at https://osmand.net/. Use of this app is mandatory to be able to drive the offered routes.
The routes offered are recreational recommendations. The driver always remains personally responsible for:
- the chosen route;
- traffic signs;
- diversions;
- road closures;
- traffic situations.
Depending on the chosen arrangement a voucher may be included. This voucher:
- is only valid on the rental day;
- entitles the holder only to the listed consumptions;
- is valid once only;
- is non-transferable;
- cannot be exchanged for cash.
Additional consumptions are for the account of the renter.
MellowMiles works with catering partners. MellowMiles is not liable for dietary wishes, allergies, ingredients, opening hours, changes in assortment or services provided by third parties. The renter remains personally responsible for enquiring about allergens and dietary information.
Ferry fares, parking costs, entrance fees and other costs along the way are for the account of the renter, unless MellowMiles explicitly states otherwise in writing.
MellowMiles reserves the right to modify routes at any time and without prior notice to the renter. Reasons may include: diversions, roadworks, unsafe or changed conditions on location, or the discovery of a better or more scenic route. MellowMiles aims to keep such changes to a minimum.
Planned culinary stops at partner venues may also be subject to change. This may result from the availability or opening hours of the relevant partner. In such cases MellowMiles will always arrange a worthy alternative.
Article 17
Range and charging
The vehicle is handed over fully charged. The range is aligned with the routes offered.
The renter is responsible for monitoring the battery level. If necessary, the vehicle may be charged en route at a public charging point. Any charging costs are for the account of the renter.
If the vehicle comes to a standstill due to an empty battery, retrieval costs of €250 will be charged.
Article 18
Force majeure
MellowMiles is not liable for delays or cancellations resulting from force majeure. This includes, among others:
- extreme weather;
- storms;
- icy conditions;
- flooding;
- power outages;
- technical failures;
- government measures;
- calamities;
- traffic situations.
Article 19
Limitation of liability
MellowMiles is not liable for:
- loss of personal belongings;
- indirect damage;
- consequential damage;
- loss of income;
- damage caused by third parties.
Any liability of MellowMiles is limited to a maximum of the rental amount paid.
Article 20
Privacy and cookies
In the context of the rental, MellowMiles processes personal data that is necessary for:
- reservations;
- performance of the rental agreement;
- identification of drivers;
- processing of traffic fines;
- handling of damage claims;
- statutory obligations.
The following are retained for every driver: a photograph of the driving licence, the signed rental agreement, the signed general terms and conditions, and the vehicle inspection photographs.
These data are retained for a maximum of three months after the end of the rental, unless a statutory retention obligation or an ongoing damage or legal procedure makes a longer retention period necessary. After this period the personal data are deleted or anonymised.
Personal data are not used for commercial purposes and are only provided to competent authorities if MellowMiles is legally required to do so or if this is necessary for the handling of fines, damage or fraud.
In addition, MellowMiles uses Google Analytics on its website to analyse how visitors use the website and to improve it. This involves placing analytics cookies. These cookies are only placed after the visitor has given consent via the cookie notice on the website. Consent can be withdrawn at any time by deleting the cookies via the browser settings.
Article 21
Applicable law
Dutch law exclusively applies to all agreements.
Disputes are submitted to the competent court in the district where MellowMiles is established.
Article 22: House rules
By using a MellowMiles vehicle the renter declares to have read and understood the following house rules.
Permitted
- Enjoying the route
- Treating nature, the surroundings and other road users with respect
- Taking photos and videos for private use and social media
- Sharing wonderful memories of the trip
Not permitted
- Drinking alcohol while still intending to drive the vehicle
- Smoking
- Vaping
- Bringing pets
- Off-road driving
- Racing or aggressive driving behaviour
- Driving under the influence of alcohol, drugs or narcotics
- Driving by unregistered drivers
When taking photos and videos, renters must be mindful of the privacy of others. Avoid as much as possible having bystanders inadvertently appear in recognisable form, and treat nature, animals and private property with respect. Photos or videos must never lead to dangerous traffic situations or inconvenience for other road users.
